Returns & Warranty

At SEM Jacht & Schietsport, we want to make it clear what you can do if you wish to return an online purchase or if there is a problem with a product.

Returning a product under the statutory right of withdrawal and making a claim regarding a faulty product are two different matters. Both situations are explained below.

14-Day Right of Withdrawal for Online Purchases

When you purchase a product from our webshop as a consumer, you will in most cases have a statutory 14-day right of withdrawal starting from the day you receive the product.

During this period, you may withdraw from the contract without giving a reason.

If you wish to exercise your right of withdrawal, you must clearly inform us within the withdrawal period that you wish to withdraw from the contract.

After notifying us of your withdrawal, you have another 14 days to return the product.

Registering a Return

If you wish to return a product, we recommend contacting us first. This allows us to identify your order and advise you on the correct return procedure.

You may notify us of your withdrawal by email or use our model withdrawal form.

Use of the model withdrawal form is not mandatory. You may also make any other clear statement indicating that you wish to withdraw from the contract.

Where possible, please provide:

  • Your name

  • Your order number

  • The product you wish to return

  • The date on which you received the order

You can download the model withdrawal form using the link below. You can use this form to return your order directly to our store.

Return Address

Products that may legally be returned by parcel carrier can be sent to:

SEM Jacht & Schietsport
Pastoor Ossestraat 9
7627 PH Bornerbroek
The Netherlands

Please package the product carefully to prevent damage during transport.

Keep your proof of postage until your return has been fully processed.

Return Shipping Costs

When exercising your statutory right of withdrawal, the direct cost of returning the product is your responsibility, unless we have expressly agreed otherwise.

The actual cost of returning a product depends on factors including the carrier, package dimensions and weight, and the country from which the product is being returned.

If a product is defective, damaged or incorrectly supplied, please contact us before returning it. A different procedure may apply in these circumstances.

Inspecting a Product During the Withdrawal Period

During the withdrawal period, you may inspect a product to the extent necessary to establish its nature, characteristics and functioning, comparable to how you would normally be able to inspect it in a physical store.

We ask you, where reasonably possible, to return the product complete and in its original packaging.

However, the original packaging is not in itself a condition for exercising your statutory right of withdrawal.

If you use the product beyond what is necessary to inspect it and this results in a reduction in value, we may take this depreciation into account.

Please therefore handle the product, its packaging and any supplied accessories with care.

Refunds

If you withdraw from the entire contract, we will refund the purchase price, including the cost of the standard delivery method paid with the original order.

If you selected a more expensive delivery method than our standard delivery option, we are not required to refund the additional cost of that delivery method.

If you return only part of an order and keep other products from the same order, the original delivery costs will not be refunded.

We will refund the amount due no later than 14 days after receiving your notice of withdrawal.

We may withhold the refund until we have received the product or until you provide evidence that the product has been returned, whichever occurs first.

Unless otherwise agreed, the refund will normally be made using the same payment method used for the original transaction.

Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to every contract or product. The law provides a number of specific exceptions.

An exception may apply, for example, to products manufactured according to the consumer's specifications or clearly personalised for a particular person, as well as other products or services for which the right of withdrawal is excluded by law.

If a statutory right of withdrawal does not apply to a particular product, we aim to make this clear before the contract is concluded.

If you are unsure whether the right of withdrawal applies to a particular product, please contact us before purchasing.

Firearms, Ammunition and Ammunition Components

Special legal requirements apply to the possession, transport and transfer of firearms, ammunition and ammunition components.

Never send firearms, ammunition or ammunition components to SEM Jacht & Schietsport by parcel carrier on your own initiative.

SEM Jacht & Schietsport likewise never ships these products by parcel carrier.

If you wish to cancel or return a purchase involving a firearm, ammunition or ammunition component, or report a problem with one of these products, always contact us first.

We can then determine which procedure applies to your situation and how any return or transfer can be carried out in a legally permitted manner.

Purchases Made in Our Physical Store

The statutory 14-day right of withdrawal generally applies to distance contracts, such as orders placed through our webshop.

If you purchased a product directly from our physical store in Bornerbroek, you do not automatically have a statutory right to return it simply because you have changed your mind.

This does not affect your statutory rights regarding faulty or non-conforming products. If a product is faulty, you may also have legal rights when it was purchased in our physical store.

Legal Guarantee

Products purchased from SEM Jacht & Schietsport are covered by the applicable statutory legal guarantee.

This means that a product must conform to what you, as a consumer, may reasonably expect under the purchase agreement. What you may reasonably expect depends on factors including the type of product, its price and age, the information provided at the time of sale, and whether the product was sold as new or second-hand.

In the Netherlands, there is no single fixed general statutory guarantee period. A product must function properly for as long as you may reasonably expect from that particular product.

Product Defective or Not as Expected?

If a product is defective, damaged, incomplete or does not perform as you could reasonably expect under the purchase agreement, please contact us.

Describe the problem as clearly as possible. Photographs or other information about the problem can help us assess your claim more quickly.

Do not return a defective product without contacting us first. We will first determine with you which solution and return procedure is appropriate.

If the product has a defect for which we are legally responsible, we will provide an appropriate solution within a reasonable period.

Depending on the circumstances, this may include repair or replacement. If an appropriate solution is not possible or cannot reasonably be required, other statutory remedies may apply.

Costs of a Valid Legal Guarantee Claim

If a product does not conform to the purchase agreement and you have a valid statutory claim, you will not be charged the necessary costs of providing the legally required remedy.

Please therefore contact us before incurring costs yourself or returning a product.

When Is a Problem Not Covered by the Legal Guarantee?

Not every defect or instance of damage automatically means that the seller is legally responsible.

A right to a free remedy may, for example, not apply when the problem was caused by:

  • Incorrect or improper use

  • Damage caused by dropping, impact or another external cause after delivery

  • Incorrect maintenance

  • Incorrect installation or modification by the user or a third party

  • Use contrary to the operating instructions

  • Normal wear and tear consistent with the age and use of the product

Whether a particular defect is covered by statutory rights will be assessed according to the circumstances of the individual case.

Manufacturer's Warranty

Some products are supplied with an additional manufacturer's warranty.

A manufacturer's warranty is in addition to your statutory rights and does not restrict those rights.

Even if a manufacturer's warranty has expired, statutory rights may still apply depending on the product and circumstances.

If you purchased the product from us and experience a problem, please contact us. As the seller, we remain your point of contact for your statutory rights.

Incorrect or Damaged Product Received

If you received a different product from the one you ordered or your order arrived damaged, please contact us as soon as possible.

Where possible, please provide photographs of:

  • The product received

  • Any damage

  • The packaging

  • The shipping label

This helps us assess the situation more quickly and find an appropriate solution with you.

Please do not return the product on your own initiative before receiving instructions from us.

Model Withdrawal Form

If you wish to exercise your statutory right of withdrawal, you may use our model withdrawal form.

Use of this form is not mandatory. You may also inform us in another clear way within the statutory withdrawal period that you wish to withdraw from the contract.

Questions About Returns or Warranty?

Do you have questions about a return, warranty claim or defective product? Please contact us before returning the product.

This allows us to determine the correct procedure for your situation.
